Delhi High Court Dismisses Law Student's PIL Seeking Bail For Kejriwal

The Delhi High Court dismissed a PIL by a law student seeking interim bail for CM Kejriwal, imposing a penalty of Rs 75,000

The Delhi High Court rejected a PIL (public interest litigation) filed by a law student on Monday, imposing a penalty of Rs 75,000. The petition sought 'extraordinary interim bail' for Chief Minister Arvind Kejriwal, who is currently in judicial custody due to a money laundering case linked to the alleged excise scam.

A bench led by Justice Manmohan stated that the petition was 'totally misconceived.' He further added that the court lacks the authority to grant 'extraordinary interim bail' to an individual holding a high public office, as per a report by PTI.

The AAP leader has the ability to pursue legal avenues to address his situation. However, the petitioner lacks the authority to represent him, as they do not hold power of attorney, as per the court.

"Person is taking steps in accordance with law. Who are you? You have some exaggerated notion of yourself. You say you have veto power. That you will give an undertaking (to ensure Kejriwal does not influence witness)," the court said during the hearing. It stressed the importance of equality and the Rule of Law in our constitution and pointed out that Kejriwal's judicial custody resulted from unchallenged judicial orders.

The court has ruled to dismiss the writ petition, with the imposition of a fine amounting to Rs 75,000.

The petitioner, who happened to be a law student, referred to himself as "We, the people of India" in the plea, stating that he sought no personal recognition, gain, or monetary benefit from the case.
