Nayanthara vs Dhanush: How a Netflix Documentary Lands Actress in a Rs 10 Crores Lawsuit

When the trailer of the documentary was released, last week, along with the controversial clip in it, Dhanush found it to be an infringement of the Copyrights Act and took a legal course against Shivan

Actress Nayanthara and her director husband, Vignesh Shivan, criticised filmmaker-actor Dhanush for not giving them the permission to use a clip from a song in the film Naanum Rowdy Dhaan. The ongoing controversy came to light when Shivan, in a post on the social media platform Instagram, mentioned a three-page legal notice that was sent to him by Dhanush’s team, demanding Rs 10 crores for the clip used by the former in his upcoming Netflix documentary.

“The 10 crores clip that wants to be taken down from our Netflix documentary. Please watch it here for free,” said Shivan in a post.

How did the controversy take a legal route?

Shivan sought permission from Dhanush to use a clip from the movie Naanum Rowdy Dhaan in his upcoming documentary, ‘Nayanthara: Beyond the Fairytale’, based on the life of his wife and actress Nayanthara. The director wanted to use the clip as it was on the sets of the movie that he met his wife and requested Dhanush, who produced the film, to give him a no objection certificate (NOC). Despite the couple chasing to get the NOC for nearly two years, they decided to use the clip. Last week, when the trailer of the documentary was released along with the controversial clip in it, Dhanush found it to be an infringement of Copyrights Act and took a legal course against Shivan.

“My client is the first and exclusive owner and has the sole and exclusive right to exercise all rights comprised in copyright in the film Naanum Rowdy Dhaan in accordance with the Copyright Act,” said Dhanush’s lawyer in the legal notice.

Nayanthara shared a letter on Instagram wherein she called out Dhanush and said the legal notice is an act of “vengeance”.

“After two years of battling it out with you for an NOC and waiting for your approval for our Netflix documentary release, we finally decided to give up, re-edit and settle for the current version since you declined to permit the usage of Naanum Rowdy Dhaan songs or visual cuts, even the photographs to say the least despite multiple requests,” said the actress in a post.
